1. How to Enter
Fill out the Facebook lead form on or after October 6, 2023 at 9:01 AM ET and on or before December 31, 2023 at 11:59 PM ET.
2. Description
The winner will receive credit for 2 free nights in a 4-bedroom resort home at Encore Resort at Reunion from NDM Hospitality Services, LLC. The retail value is estimated to be $1,500.00. The free nights cannot be combined with any other discount or promotion. Blackout dates and some restrictions may apply.
3. Eligibility
Entries generated by automated means, from Quebec or residents of Quebec or other territory where prohibited or regulated by law, that are incomplete, from persons residing in a household with or that are immediate family members of a person employed by or contracted by NDM Hospitality Services, LLC or its affiliates, from 3rd party email addresses, and from persons lacking legal competency or under the age of 25 will be disqualified.
4. Winner Selection and Notification
The winner will be randomly selected by an independent accountant or accountancy firm. The winner will be announced on January 5, 2024 and notified by email or social media. The winner will have 90 days from notification to redeem the prize by making a reservation at Encore Resort at Reunion by any generally acceptable Encore Resort at Reunion reservation method. The free nights must be used by January 5, 2025. If from the U.S., a valid social security number is required and a Form 1099 for the retail value of free nights will be issued to the winner. No substitute winner will be selected if the winner does not redeem the prize.
5. Conditions of Participation and Releases
Maximum value is $5,000.00. There is no cash value. Free nights are nontransferable and cannot be exchanged for other prizes. Odds of winning depend on the number of eligible entries. The winner’s name and city of residence are available upon request. The winner consents to having their name, family name, photograph, family photograph, and city of residency made available, published, and made public for 5 years. Headings are solely for convenience and neither constitute part of the agreement nor affect its interpretation. This agreement shall not be construed in favor of the non-drafting party. Only Nick Falcone has authority to modify this Agreement and can do so only in writing. If any provision of this Agreement is invalid or unenforceable under governing law, it shall, to the extent possible, be construed or applied in such a manner as will permit enforcement; otherwise this Agreement shall be construed as if that provision had never existed. No warranties exist unless expressly stated and are not merely implied. The non-drafting party acknowledges that he/she/it has not relied upon any current or prior representations or understandings and waives any rights or claims arising from the same. The exclusive remedy for breach of this contract is limited to actual financial losses. Regardless of the failure of the exclusive remedy, seller will not be liable for consequential damages. The Ninth Judicial Circuit of Florida shall be the exclusive forum for any claims related to this agreement unless there exists exclusive Federal jurisdiction, in which case it shall be the U.S. Dist. Ct. for the Middle Dist. of FL. Law. Any dispute between the parties, whether arising out of this agreement or otherwise, shall be governed by the laws of FL to the exclusion of all other laws, conflict of law principles, and other legal theory bases. Jury. The parties waive their rights to a jury trial. NDM Hospitality Services, LLC disclaims liability for technical issues which can occur notwithstanding reasonable efforts, including but not limited to, website unavailability or entries lost in transmission.
